Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Online Chess Club website (the "Service") operated by 32 Pieces ("us", "we", "the Club", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Membership
To register for any activity in 32 Pieces, you must provide accurate and complete registration information. You are responsible for the security of your password and for any activity that occurs under your account. You agree to notify us immediately if you suspect any unauthorized use of your account or access to your password.
2. User Conduct
Treat all members with respect and courtesy.
Refrain from using offensive language or content.
Not engage in cheating, hacking, or any activity that would compromise the integrity of the Service.
Comply with all applicable laws and regulations.
We reserve the right to remove or suspend your access to the Service if you violate these Terms or engage in behavior that we deem inappropriate or harmful to the community.
3. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of 32 Pieces and its licensors.
4. Limitation of Liability
In no event shall 32 Pieces, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
5. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of Connecticut, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
7. Media Rights Release
By participating in any event or activity organized or associated with the Online Chess Club, you grant 32 Pieces and its affiliates, agents, partners, and representatives (collectively, the "Club") the irrevocable, perpetual, worldwide right to:
Take, record, use, reproduce, display, and distribute photographs, videos, audio recordings, and any other media of you (the "Media").
Use, edit, modify, adapt, and create derivative works from the Media.
Use your name, likeness, image, and voice in connection with the Media.
Use the Media, or any portion thereof, for promotional, advertising, educational, or any other purpose related to the Club's activities and events.
Any Chess games you have played during any of the Club's event.
You acknowledge and agree that you will not be entitled to any compensation, royalties, or other payments in connection with the Club's exercise of the rights granted under this Media Rights Release. You hereby release the Club from any and all claims, actions, or liability arising from or related to the Club's use of the Media.
By participating in the Club's events and activities, you represent and warrant that you have the right and authority to grant the rights contained in this Media Rights Release, and that the Club's use of the Media in accordance with this Media Rights Release will not infringe upon the rights of any third party.
If you do not wish to grant the Club the rights set forth in this Media Rights Release, you must notify the Club in writing prior to participating in any event or activity. Failure to provide such notice will be deemed as your acceptance of the terms of this Media Rights Release.
8. No Refunds
All transactions, including membership fees, purchases, and donations made through the Online Chess Club are non-refundable. Once a transaction is completed, it cannot be reversed or refunded. You acknowledge and agree that 32 Pieces will not be liable to you or any third party for any refunds, reimbursements, or other compensation for any reason, including but not limited to dissatisfaction with the Service, technical issues, or cancellation of your membership.

10. Severability
